Legal provisions for using the SWICA websites
Preamble
SWICA Healthcare Organisation (SWICA Group, consisting of SWICA Healthcare Insurance Ltd, SWICA Insurance Ltd. and SWICA Health Ltd – hereinafter referred to as “SWICA”) is committed to maintaining transparent relations with its stakeholders. The following special conditions govern the access to the SWICA websites and subpages.1. General
1.1 Declaration of consent
By using the SWICA websites and all their subpages (jointly referred to hereinafter as the "Websites"), you declare that you understand and agree to the following special conditions (hereinafter referred to as the "Conditions") that govern their access. Please use the Websites only if you agree to the following Conditions.1.2 Scope
These Conditions apply to all instances in which SWICA's Websites are accessed.The use of special services (such as the premium calculator and mySWICA, Benevita and Benecura apps) is subject to the respective special conditions. The data privacy policy (e.g. data privacy statement on the use of the SWICA websites) and the cookie policy apply in addition to these Conditions, and take precedence if there is a contradiction in meaning.
All matters pertaining to the insurance business fall outside the scope of these Conditions. Please refer to the respective General Insurance Conditions (GIC) and Supplementary Conditions (SC), as well as any other conditions (such as Special Insurance Conditions).
1.3 Purpose of the Websites
The SWICA Websites are designed to provide information about SWICA and its products and services.2. Intellectual property rights
All rights (including copyrights and trademark rights) to the Websites and their content shall remain with SWICA or the relevant rights holder. The Websites or parts thereof may only be downloaded or printed out for private purposes. Under no circumstances does this grant any licence or right to use an image, a registered trademark, a logo or any other content of the Websites. Downloading or copying the Websites also does not transfer any rights with respect to the code, software or other elements of the Websites. SWICA's consent in writing shall be required for any use other than for private purposes (reproduction, use for public or commercial purposes, etc.). This also applies to the systematic accessing of the Websites' content (for example by web crawler/spider programs, meta search engines, framing).3. No warranty for the completeness or correctness of the Websites
SWICA endeavours to create the Websites, and to continuously review and update them, with due care and to the best of its knowledge. However, SWICA and its contractual partners offer no assurance or guarantee with regard to the currentness, completeness or accuracy of content.4. Disclaimer
SWICA cannot be held liable for any direct or indirect damages and/or consequential damages arising from the use of the Websites or access to the Websites or links to third-party websites (or from the inability to use and/or access the SWICA or third-party websites). Liability is explicitly excluded for erroneous or incomplete content on the Websites, technical faults, transmission errors, misuse or the actions of third parties.5. Links to other websites
SWICA does not monitor third-party websites that are linked to its own Websites and cannot be held accountable for their content. Users who establish links to such websites do so at their own risk.6. Social networks
The SWICA Websites use various social media plugins, including those of the following network providers: Facebook, Google Plus, YouTube, LinkedIn, Xing, X and Instagram. These social networks can be identified by their respective logos and/or names. The trademarks of the network providers are protected by trademark law, and do not belong to SWICA. The use of social media plugins is at users' own risk. Further provisions on data exchange by the respective network providers can be found in the data privacy statement on the use of SWICA Websites.7. Final provisions
These Conditions, and any disputes or claims arising in connection with the use of these Websites, are subject exclusively to substantive Swiss law, to the exclusion of private international law, other conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is Winterthur, Switzerland.SWICA reserves the right to make changes or additions to the information or data provided, or to the present Conditions, at any time and without prior notice.
